The Certification of Specialisation in Competition Law is a 3 Months programme designed to give a law students an understanding of Competition Law. Here you will learn about the need for competition law in India and the manner in which the Competition Commission of India regulates the market. This will be followed by a detailed study of the different types of agreements that are considered anti-competitive, including both vertical and horizontal agreements. Through this Course, we will examine the meaning of cartels and the manner in which they are prohibited in India. We will also look at abuse of dominant power and understand the different ways in which an entity can abuse its power. Finally, we will study how competition law treats mergers and acquisitions in India. By the end of this Course, you will have a working understanding of the manner in which competition law regulates the market both from an Indian as well as a EU perspective.

With the Competition Act, 2002, India got its first comprehensive anti-trust legislation aimed at regulating the market rather than focusing solely on prevention of monopolies. Competition law is vital for a smooth and fair market where players can effectively compete with each other to provide the best product to the consumer. Knowing this law is absolutely vital as it not only affects the types of agreements that corporates can enter into, but also regulates business activity to ensure that it is not anti-competitive and does not reduce or limit the choice available to consumers.

This Course Consist of the following contents -1.Introduction to Competition Law: Basic Principles -What is competition law and why is it required? Learn the basic principles of competition law including the economic underpinning of the law. Study price and cost determination in perfect competition and monopoly situations. 2.Understanding Competition Law in India -Analyse the change from the MRTP regime to the Competition Act, 2002. Study the appointment and structure of the Competition Commission of India (CCI) and the Director General ‘s department. Examine the inquiry process for anti-competitive agreements, abuse of dominance, and merger control. 3.Understanding Anti-Competitive Agreements -What is an ‘agreement’? What are the types of prohibited anti-competitive agreements? Learn the difference between the ‘per se’ and ‘rule of reason treatment. Study the concept of ‘appreciable adverse effect on competition’. 4.Understanding Horizontal Agreements -Learn about trade associations and cartels. Study the manner in which market information can be exchanged between competitors. Examine the leniency policy in India. 5.Understanding Vertical Agreements -Study the different types of vertical agreements in the market. Examine the rule of reason approach for vertical agreements. 6.Defining Dominance -Study the manner in which the Competition Act,2002 treats dominant enterprises. Analyse the different elements in defining dominance. Learn about the link between a relevant market and the finding of dominance. 7.Understanding the Abuse of Dominant Position -Identify types of abuse of dominance. Learn about the meaning of ‘bundling of products’. Study the meaning of ‘predatory pricing’. 8.Unit 8:Understanding Merger Control -Study the thresholds at which transactions are notified under the Competition Act, 2002. Learnabout the transactions that are exempt from filing requirements. Examine the different forms that need to be filled for notification of transactions.
